Terms of Service

These Terms of Service (“Terms”) govern your use of Rainku (“Rainku,” “we,” “us”), the rain-and-journal experience available at rainku.com. By creating an account or otherwise using the service you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Rainku. If you are under the age of majority in your country, you may use Rainku only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

2. Your account

• You are responsible for activity on your account, including content you write or generate.
• We sign you in via one-time email codes; keep access to your email secure.
• You may use Rainku anonymously without signing up. Anonymous accounts have limited features and may be hard-deleted automatically after a period of inactivity.
• One person, one account. Don’t share or sell access.

3. Subscriptions, credits, and payments

• Rainku offers paid subscriptions and one-time credit packs. Pricing and inclusions are shown at checkout. Payments are processed by our merchant Creem; their merchant terms also apply when you pay.
• Subscriptions auto-renew at the end of each billing period at the then-current price unless you cancel. You can cancel any time from Account → Subscription. Cancellation takes effect at the end of the current period; you keep paid features until then.
• Credits are a virtual unit used to power AI features. They are non-refundable and have no monetary value outside Rainku. Subscription credits replenish each billing cycle and do not roll over. Top-up credits remain in your account until used or until your account is deleted.
• Refunds. If a payment was charged in error or a feature was not delivered, contact support within 14 days for a refund review. Subscription cancellations are not retroactive.
• Pricing changes. We may change prices. We’ll give you at least 14 days’ notice before a price change applies to a subscription you already hold.
• Taxes — prices may exclude VAT or sales tax depending on your jurisdiction; tax is added at checkout where applicable.

4. Acceptable use

You agree not to:

• Use Rainku to threaten, harass, or harm any person, or to plan illegal activity.
• Upload or generate sexual content involving minors. We do not allow CSAM under any circumstance.
• Attempt to bypass security, rate limits, or anti-fraud controls.
• Reverse-engineer, scrape, or systematically extract content from Rainku for resale or for training third-party AI models without our written permission.
• Use Rainku to send spam, malware, or to phish other users.
• Impersonate Rainku staff or other users.

Violation may result in account suspension or termination. Serious violations may be reported to law enforcement.

5. Your content

• You keep ownership of everything you write — journals, chats, voice transcripts. Rainku does not claim your content.
• You grant Rainku a limited license to host, store, transmit, display, and process your content as required to operate the service for you (for example, sending your prompt to an LLM provider so a response can come back).
• You can delete your content at any time. Deleting your account removes everything within 30 days. Backups are purged within 30 days.
• You are responsible for your content. Don’t upload content that infringes someone else’s rights or that you don’t have permission to share.

6. AI companion content

• Replies from the rain-spirit companion are generated by large language models. They are not authored by Rainku staff and they are not the advice of a licensed professional.
• AI-generated replies can be wrong, biased, or out-of-date. Do not rely on them for medical, legal, financial, mental-health, or safety-critical decisions. If you are in crisis, please contact a local emergency service.
• Subject to the LLM provider’s terms, you may use AI-generated replies for your own personal, non-commercial purposes. Different providers may apply different rules; we surface these where relevant.

7. Our intellectual property

Rainku, the rain-spirit companion, the rainku.com brand, the visual style, and the application code are our property and protected by copyright, trademark, and other laws. These Terms grant you a personal, revocable, non-transferable license to use Rainku as intended. They do not grant you any right to our trademarks or to redistribute our software.

8. Termination

• You can stop using Rainku at any time and delete your account from Account → Your data.
• We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the service. We will give reasonable notice unless doing so would harm Rainku, our users, or third parties.
• Sections that by their nature should survive termination (Your content license, Disclaimers, Limitation of liability, Governing law) survive.

9. Disclaimers

Rainku is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or trade usage.

We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that AI replies will be accurate. We are not a substitute for professional medical, mental-health, legal, or financial advice.

10. Limitation of liability

To the maximum extent permitted by law, Rainku and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with the service.

Our aggregate liability for any claim arising from or in connection with the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50.

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold Rainku harmless from any claim arising out of (a) content you submit, (b) your violation of these Terms, or (c) your violation of someone else’s rights.

12. Changes to the service or these Terms

• We may add, change, or remove features at any time.
• We may update these Terms. For material changes we will notify you in-app or via email and update the “Effective” date above. Continued use after the change means you accept the updated Terms. If you don’t accept, stop using Rainku and delete your account.

13. Governing law and disputes

These Terms are governed by the laws of Hong Kong SAR, without regard to its conflict-of-law rules. Disputes will be resolved in the courts of Hong Kong SAR, except where mandatory consumer-protection laws give you a different forum.

Before filing any legal action, please email us at the address below; we’ll try to resolve the issue with you informally.

14. Miscellaneous

• If any part of these Terms is unenforceable, the rest remains in effect.
• Our failure to enforce a provision is not a waiver of our right to enforce it later.
• These Terms, together with our Privacy Policy, are the entire agreement between you and Rainku for the service.
• You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
